Frequently Asked Questions about the Drive Legal Program
How does the program work?
All open cases that qualify for the program are included in the assignment. Cases are removed from the collection agency. Infractions are given community service hours. Criminal Traffic cases are given court costs. Traffic school is also assigned based on the number of moving violations the person has. A due date of ninety days is given to complete the assignment. All paperwork must be turned in on or before that due date in order to successfully complete the program. Upon completion of the program, all the cases included in the assignment are closed with the exception of cases where courts costs are owed. Those cases are placed on a payment plan and will remain open until the final payment is made. While on the payment plan, the person is issued D-6 Clearances for re-instatement of their license.

How many tickets does a person need to have to benefit from the program?
There is no exact number of cases a person needs to have to benefit from the program. A person can benefit from the program in different ways. They can avoid becoming Habitual Traffic Offenders if they have many Driving While License Suspended citations by receiving statute amendments authorized by the State Attorney’s office. A person can receive minimal points for moving violations by completing a traffic school course. The program can reduce costs to be paid by assigning community service hours for payable infractions. Lastly, they can enter a payment plan which will allow the reinstatement of their driver’s license, though they have not paid their courts costs in full. These are some of the ways a person can gain from the program regardless of the number of citations they may have.

How long does the program take?
Each person is given 90 days to complete the program. However, a person can complete the program as quickly as they choose within that time frame.

When does a person qualify for the program?
A person qualifies for the program when their license is suspended by the Department of Motor Vehicles for:
1. Failure to pay fine
2. Failure to appear for traffic summons
3. Failure to complete court ordered traffic school.

How much does the program cost to enroll?
There is a $175.00 enrollment fee. At the time of enrollment, a person may choose to pay the full amount or a partial payment of no less than $100.00. The fee must be paid in cash. The balance will be due upon completion of the program. In the case where a person is court ordered to the program, the enrollment must occur within 10 working days or a $15.00 late fee will be incurred, bringing the total enrollment fee to $190.00.

Other than the enrollment fee, are there any other fees that need to be paid?
Yes, there is a fee for supervision of the community service hours performed that must be paid to the Advocate Program. The fee schedule is as follows:

50 hours or less = $25.00
51 hours or more = $30.00

Does the program accept cases which are in a collection agency?
Yes. The program will remove cases from collection agencies and the customer will be able to pay or do community service hours for the original amount on the citations.

Where can I do my community service hours?
Community service hours can be completed at any non-profit organization approved by the Advocate Program.

Will I get points on my license?
A person may or may not receive points on their license depending on the number of moving violations they have. The program is authorized to withhold 2/3 of the points normally incurred on moving violations; however, 1/3 of points will still be applied.

Can I drive while I’m in the program?
No. Upon enrollment into the program, a No Drive Order is issued to each person stating that they may not drive until they are in possession of a valid driver’s license.

How does the payment plan for court costs work?
Once the person has completed the community service hours and any traffic school class that may have been assigned, if they cannot pay the court costs amount in full, they may enter a payment plan. There is a $25.00 fee to enroll in the payment plan which is added to the total amount due. A 20% deposit of the money owed is required to begin a payment plan. The monthly payment amount will be determined based on income.

Does the payment plan have to be paid in full in order to be eligible to reinstate their driver’s license?
No. A person can reinstate their license while still making payments on the payment plan. However, should a payment be late or not paid, the license shall be re-suspended for failure to pay traffic fines.

Do I have anything else pending on my license?
In an effort to assist the person in resolving all their pending license issues, Drive Legal will identify any additional, outstanding suspensions a person may have at the time of closing. This includes suspensions from other counties or from the Department of Motor Vehicles.

What happens if I don’t complete the program on time?
Once the due date on an assignment has passed, the person has failed the program. Cases are returned to their original status prior to being enrolled in the program. Criminal cases are set for report on a judge’s calendar, and infractions return to collection agencies. However, there is the opportunity for an extension of the program assignment for an additional 90 days with the payment of a $50.00 fee. The person must come to a Drive Legal office to receive the extension.

Do you accept cases from other counties?
No. Each county is independent from each other. We can only access and assist with Miami-Dade County traffic citations.

Is there a Drive Legal Program in another county?
No. The Drive Legal program is unique to Miami-Dade County and is not offered anywhere else.
