Probate Division

The Probate Division has jurisdiction over a broad category of cases including mental health, guardianship, estates and trusts. Six circuit judges and two general magistrates are assigned to hear cases in the Circuit Probate Division. The judges and support personnel of this division are located at the Osvaldo N. Soto Miami-Dade Justice Center.

The ePortal is utilized to submit documents to Clerks and also provides electronic notifications and eService on behalf of others.

Mental Health

The Probate Division hears cases for the involuntary evaluation and treatment of mentally ill persons.

Marchman Act

Provides the means for an individual to receive voluntary or involuntary treatment for substance abuse.

Guardianship

Guardianship is a legal proceeding in which a guardian exercises the legal rights of an incapacitated person who lacks the ability to care for himself.

Probate Professional Guardian Registry

The 11th Judicial Circuit maintains a registry of professional guardians (the Registry) who practice in Miami-Dade County and are qualified to receive court appointments. When a judge needs to appoint a professional guardian for a ward, and it is not possible or would not be in the best interest of the ward to appoint one chosen by the parties, a professional guardian is selected on a rotating basis from this Registry.

Eldercaring coordination

Eldercaring coordination is a dispute resolution process in which a professional eldercaring coordinator can be appointed by the court to assist elders, legally authorized decision-makers, and other related parties with resolving disputes in a manner that respects the elder’s need for autonomy and safety.

Probate of an Estate

Probate of an estate is a legal process through which the assets of a deceased person are inventoried, distributed to pay creditors' claims against the estate, and, if there are remaining assets, distributed to the heirs or beneficiaries.

Department of Translation and Interpretation

Court Interpreters interpret and translate verbal and written communications from a non-English to English language in court proceedings.

Request for Qualifications (RFQ)

The purpose of this RFQ is to solicit proposals in accordance with established procedures to meet the requirements of developing a list of court-approved organizations to provide instruction and education for Guardians within 4 months of appointment, as set forth in section 744.3145, Florida Statutes.
