NOTICE TO INDIVIDUALS WHO MISSED COURT PROCEEDINGS

OR LEGAL DEADLINES DUE TO

HURRICANE IRMA

 

The Administrative Office of the Courts for the Eleventh Judicial Circuit of Florida has issued the following instructions for individuals who missed court dates or legal deadlines due to Hurricane Irma.
 

If you missed a court date, traffic hearing or any other court deadline due to Hurricane Irma, please read the following information carefully:

  1. If you previously scheduled a hearing using the courts’ online scheduling system, please reschedule your hearing utilizing the same system online.

Neither the Clerk’s Office nor the Court will reschedule cases that were scheduled online.

All other cases will be rescheduled by the clerk, judicial assistant or case manager and parties will receive written notice with the new date.
 

  1. You do not need to call or visit the courthouse to reschedule your hearing or court date during the time that the Miami-Dade Courts were closed due to Hurricane Irma. Either the Clerk’s Office or a representative from the court (judicial assistant or case manager) will send you written notice with your new court date. If you have an attorney, the new notice will only be sent to your attorney.

Please be patient. The courts have been closed for seven business days and it will take time to reschedule all the cases affected during those dates.
 

  1. If you received a traffic ticket or other fine, you may proceed to the Clerk's Office to pay the fine. Please click on this link for a list of Clerk’s Office locations.

    All persons who were scheduled for a traffic court hearing will receive written notice when the case is assigned a new hearing date. Individuals may also look up their cases online via the Clerk's Office website at www.miami-dadeclerk.com to find further information.
     
  2. If you had a domestic violence restraining order in place, it will remain in place and enforceable until your case is heard by a judge.
     
  3. If you were a respondent in a case where a domestic violence restraining order was served on you, you must continue to abide by the terms of the injunction until a judge has ruled on your case.
     
  4. Foreclosure sales will resume normal schedules on Monday, September 25, 2017.  Any foreclosure sale cancelled due to the hurricane will be rescheduled to a future date by the Plaintiff in the case.

    The Foreclosure Sale Cancellation Calendar will resume at 8:15am on September 25, 2017, in Courtroom 3-3 of the Dade County Courthouse, 73 West Flagler Street.

    Please be patient. It may take a few weeks to reschedule the new sale dates.

    Eviction notice deadlines will be extended pursuant to an Order Extending Deadlines, which will be issued by the Florida Supreme Court. An Order Extending Deadlines extends all legal deadlines for the time the courts were closed during Hurricane Irma.
     
  5. If you are charged with a criminal offense and missed a court date, you do not need to call the Clerk’s Office or the presiding judge’s office. Your case will be rescheduled to a future date and written notice will be sent to you or your attorney.
     
  6. Any person required to register with probation or otherwise comply with a court order that occurred prior to the courts closing on September 6, 2017 will be given seven (7) additional business days to comply with the order.
     

All time limits established or allowed by rule of procedure, court order, statutes applicable to court proceedings, or otherwise pertaining to court proceedings will be extended by an Order Extending Legal Time Limits from the Florida Supreme Court, which will be posted on the Miami-Dade Courts’ website once issued by the Chief Justice.


Please be patient as court services resume on September 18, 2017 and court staff members work to resume daily court operations.
