 Only motions that comply with the conferral certification requirement of Florida Rule of Civil Procedure 1.380(a)(2)* may be set for hearing in this division. (*“The motion must include a certification that the movant, in good faith, has conferred or attempted to confer with the person or party failing to make the discovery in an effort to secure the information or material without court action.”) This divisional requirement applies to ALL motions, whether discovery-related or otherwise.
If only attempted conferral (not actual conferral) has occurred, the movant must set forth in the motion details about the attempts to confer (i.e., date, time, means of communication, and person(s) involved). After filing the motion, the movant must continue to attempt to confer and set forth in the notice of hearing details about the attempts to confer or state that the parties have conferred and do not agree. If the Court finds the attempts to confer insufficient, it may cancel the hearing pending actual conferral or sufficient attempts to confer.

A discovery motion must attach as exhibits all documents necessary for the Court’s consideration of the motion. For example, a motion to compel better answers to interrogatories must provide the interrogatories and the responses; a motion to overrule objections to requests for production of documents must provide the requests and objections; etc.
