  • You Must give 7 business days Notice.
  • A copy of the Motion and Notice of Hearing must be submitted through ecourtesy (in PDF format) at the same time, if the Motion and Notice are not submitted through ecourtesy the motion will not be heard.  Proposed Orders must be uploaded to ecourtesy in Word format.
  • The Court routinely dispenses with oral argument or the need for a hearing on pretrial, non-evidentiary motions.  See, e.g., Nudel v. Flagstar Bank, FSB, 52 So. 3d 692, 694 (Fla. 4th DCA 2010) (“We are aware of no rule or law that requires a trial court to hear oral argument on a pretrial, non-evidentiary motion.”); Gaspar, Inc. v. Naples Fed. Sav. & Loan Ass'n, 546 So. 2d 764, 766 (Fla. 5th DCA 1989) (“Judicial consideration and determination of a non-evidentiary motion on the basis of memoranda of law rather than oral argument by counsel at a noticed hearing does not constitute an ex parte hearing or a denial of due process.”).  Each party opposing any written motion or other application shall file and serve, within five (5) days after being served with such motion or application, a legal memorandum with citations of authorities in opposition to the relief requested.
  • Pro Se Litigants are Required to file documents in person with the Clerks Office.   
  • To Cancel a hearing on Motion Calendar, the party that noticed the hearing is required to submit a Notice of Cancellation via ecourtesy.

  • A party noticing objections to its discovery, or moving to compel betters answers to its discovery, must provide the Court with the original discovery request(s) and the response(s) to it through e-courtesy, or quote them verbatim in the motion.
  • Motions for Reconsideration should not be set for hearing unless instructed to do so by the Court.  Upload the Motion for Reconsideration to proposed orders in eCourtesy.  The Court will review the motion and instruct the parties on how to proceed.
