Judge Fine has opened up Special Set time on September 29th through October 1st from 10:00 AM to 12:00 PM. 7 days notice is not needed for these dates if all parties are in agreeance.

Due to the closure of the Dade County Courthouse, all hearings will be held via Zoom until further notice. Jury Trials will still be taking place in person.

Filing a motion for stay or for reconsideration does NOT relieve the party from complying with the court order and cases may be dismissed for failing to comply with court orders. See, Mercer v. Raine, 443 So. 2d 944 (Fla. 1983) and Cal v. Forward Air Solutions, 199 So. 3d 312 (Fla. 3rd DCA 2016).  “There are avenues of redress by appellate review for orders which may be erroneous, but so long as such orders are entered by a court which has jurisdiction of both the subject matter and the parties, they cannot be completely ignored without running the risk that an appropriate sanction may be imposed.” Johnson, 410 So. 2d at 980.

Ex Parte Motions to Compel Discovery in Civil Actions View

 

Motion Calendar in Division 2 is held via Zoom every Tuesday, Wednesday, Thursday, and Friday at 9:00 AM and 9:30 AM. This includes Foreclosure Motions.

IF IT IS AN EMERGENCY, FOLLOW PROCEDURES FOR EMERGENCIES. IF IT IS NOT AN EMERGENCY IT IS YOUR OBLIGATION TO MAKE SURE THAT YOUR MOTION IS HEARD BEFORE YOUR COMPLIANCE DEADLINE. 

PLEASE DO NOT SUBMIT PAPER COURTESY COPIES OR BINDERS ON ANY MATTER IN THIS DIVISION. 

 Motion Calendar Procedures:

In order for your matter to be added to the Judge’s Motion Calendar, YOU MUST:
File motion with the Clerk; and Coordinate hearing with opposing counsel using CourMap.

Once the hearing is scheduled then upload a Notice of Hearing with the Clerk.

Upload motion, including supporting documents, if any,  via CourtMAP under "Motion Calendar"  at least seven (7) days prior to the hearing  or the matter will NOT be heard.

Zoom links are sent out through CourtMap approximately one week before the hearing. If a Zoom link is needed for the Notice of Hearing please email Chambers and request the link.

Responses:  Parties wishing to submit a response to a matter set on Motion Calendar must file said response with the Clerk and submit it via CourtMAP under "Motion Calendar" case number and hearing date, prior to the hearing date.

EX PARTE MOTIONS TO COMPEL: Before filing an ex-parte motion to compel please make sure you have complied with Eleventh Circuit Court Administrative Order No. 06-09 .  Motions that do not reflect compliance with the Administrative Order will be summarily denied.

Efiling is not the same as courtMAP: Matters that are only e-filed WILL NOT automatically upload to the Judge’s Motion Calendar. Efiling is for documents to be filed with the Clerk's Office electronically. CourtMAP is used to submit courtesy copies to chambers electronically.

Cancellations:  Counsel for the party who placed a matter on the Motion Calendar shall file the notice of cancellation with the Clerk. If the case was set through CourtMAP you must cancel it through CourtMAP. If the motion was set prior to CourtMAP you must fax or email a copy to Division 2 at 305-349-7603, or dediaz@jud11.flcourts.org prior to scheduled hearing. DO NOT CALL CHAMBERS TO CANCEL.

Making Calendar:  In order to verify if your case made the Calendar: 
    a. Log onto Court Map;
    b. Select “calendar” on top;
    c. Select “show events by case”;
    d. Enter your case number & click on the magnifying glass; and
Your case hearings will populate

courtMAP is a new online Management and Access Platform built upon technology infrastructure from Broward’s Court Management System.

courtMAP combines eCourtesy with online scheduling, online notification/confirmation, and allows judges to create and e-File orders. courtMAP also allows parties to self-schedule their case events - motion calendar, special sets, and trials - and attach the documentation previously submitted via eCourtesy.
