Special Set hearings and Motion Calendar hearings, contact Judicial Assistant Isabel
Del Castillo at 305-569-2506, Monday through Friday between the hours of 9:30
to 11:30 am and 1:30 to 3:30 pm with opposing counsel on the line. YOU
WILL NOT MAKE MOTION CALENDAR IF YOU DO NOT CALL CHAMBERS.
If your motion
will take you more than 5 minutes, then please special set it; this includes
discovery motions that go item by item and will require more than 5 minutes to
review. No Motions for Summary Judgment
will be heard on Motion Calendar even if you think they will take 5
a hearing (this includes motion calendar) please have your opposing counsel on
the line via conference call. Unless
both lawyers are on the phone, no hearings will be set.
appearances are permitted. A written
motion MUST be filed and a proposed order granting the motion must be submitted
via e-courtesy. The proposed order MUST
contain a telephone number where the attorney may be reached. If a voice mail answers, then the party may
have to re-schedule the hearing.
No more than three
(3) motions may be set on Motion Calendar for the same case. NO ADD ONS will be allowed. The
Notice of Hearing for ANY hearing must contain the title of the motion to be
heard and the date that motion was filed.
If the motions
are resolved, please file a Notice of Cancellation prior to hearing date. You
may fax the Notices of Cancellation to 305-569-2508.
A party may request to set a matter unilaterally
only if reasonable attempts to reach the opposing party have been unsuccessful
and the opposing party has been given reasonable opportunity to respond. After
receiving a date and time for a unilaterally set hearing, the notice must
include the language that undersigned set this matter unilaterally after good
faith efforts to reach the opposing party were unsuccessful.
If the opposing party is not represented and
counsel lacks contact information for the unrepresented party, you may call the
Judicial Assistant without having the opposing party on the line. If
counsel has a phone number or email for the opposing party, counsel must follow
the procedure outlined above for unilaterally setting hearing after a reasonable
attempt to communicate regarding the hearing.
