SCHEDULING A MATTER FOR HEARING

5 Minute Motion Calendar

Motions must be scheduled with courtMAP only.

If the parties cannot coordinate a date and time of a hearing, then both parties must email the Judicial Assistant. If the parties agree on a date and time, then only one party needs to schedule the hearing.

The motion must take only 5 minutes of hearing time. Any motion requiring more than 5 minutes, the Court will cancel the hearing such as a motion to dismiss, motion to strike and motion for sanctions. These motions are not to be heard on the 5-minute motion calendar. As such, it needs to be set as a special set hearing. If you schedule a motion exceeding 5 minutes, it will be taken off the calendar.

At least 5 business days prior to the hearing, any documentation for the hearing must be submitted on the docket and by email.

All motions must be uploaded to the eFiling System no later than (5) business days before the scheduled hearing. Only proposed orders and agreed orders are to be uploaded to CourtMAP All orders must be in Microsoft Word format.

Unilaterally Set Hearing Procedures.

A party may request to set a matter unilaterally only if reasonable attempts to reach the opposing party have been unsuccessful and the opposing party has been given reasonable opportunity to respond. After receiving a date and time for a unilaterally set hearing, you must email the Judicial Assistant attaching correspondence between both parties. The unresponsive party has 3 days to respond to the email. If no response is given, the matter may be set on calendar. The notice must include the language that undersigned counsel set this matter unilaterally after good faith efforts to reach the opposing party were unsuccessful.

If the opposing party is not represented and counsel lacks contact information for the unrepresented party, you may call the Judicial Assistant without having the opposing party on the line.  If counsel has an email for the opposing party, when following the procedure outlined above, must copy the opposing party on the email to the Judicial Assistant for unilaterally setting hearing after a reasonable attempt to communicate regarding the hearing.

NOTICE OF CANCELLATIONS

Cancellations should be emailed to the Judicial Assistant or faxed to 305-354-8729 at least 24 hours prior to the scheduled hearing. If the cancellation is made less than 24 hours prior to the scheduled hearing, counsel must call chambers at 305-354-8772 to notify them of the cancellation.

NOTE: Landlord\Tenant cases will not be heard on the motion calendar, please email the Judicial Assistant
at jcordoba@jud11.flcourts.org to schedule a special set.
