Foreclosure Matters

Effective August 10, 2018: All Foreclosure Sale Cancellations will be handled during the Foreclosure Motion Calendar on Monday’s at 9:00 AM.  All motions (including Motions to Cancel Foreclosure Sale) and the corresponding Notice of Hearing must be filed via eCourtesy at least seven (7) business days in advance. There should be no “emergency sale cancellations” as sale dates are scheduled well in advance.  Therefore, do not wait until the last minute to move to cancel a sale.

In the rare instance of an Emergency Motion to Cancel “a same day” Foreclosure Sale the Motion and Notice of Hearing must be emailed to Judge Butchko’s bailiff Robert Morcate at rmorcate@jud11.flcourts.org  and judicial assistant Dethie Castillo at dcastillo@jud11.flcourts.org at least 24 hours in advance.  In those instances, the matter should be noticed for hearing at 8:45 AM after confirmation from the Judge’s staff.
