DIVISION 62 PROCEDURES: To place a case on Judge Hersch's calendar: Email your request along with a proposed agreed date and copy of the motion to f062@jud11.flcourts.org- please be advised all parties to the case must be included in the email.
If you are e-filing motions, please add the division's email in the e-filing portal to ensure chambers receives a copy.
PLEAS: When an agreed plea is taking place, the defense attorney must fill out our plea form that is attached and turn in personally or scan to the JA BEFORE the plea takes place. - DEFENDANTS MUST APPEAR IN PERSON for TRIAL, PLEAS, EVIDENTIARY, & to QUASH A/C. -Defendant's must be present for all hearings, unless previously excused by the Court.
JAC RELATED HEARINGS:
For Motion to Declare Defendant Indigent for Costs, submit the motion to chambers along with supporting documentation, JAC’s response, and a proposed order. If JAC does not request a hearing, the Court may enter the proposed order without a hearing after reviewing the documents. If JAC requests a hearing, or if Judge Hersch has concerns after reviewing the Motion and supporting documentation, the JA will contact the attorney and set a hearing.
To set a hearing regarding attorney fees, please keep in mind that JAC requires 20 days when issuing a notice of hearing. Please provide chambers with all necessary JAC-related documents prior to the scheduled hearing. If a reset is needed for the hearing, notify both JAC and chambers days in advance so new dates can be provided to all parties. Call chambers to speak with the JA if additional guidance is needed.
