Administrative General Magistrate: Circuit Family Matters (General Magistrates)


The Courthouse is now open and normal operations have resumed.  Most hearings in front of a General Magistrate in the Family Division are either trials or evidentiary hearings.  It is presumed that these types of hearing will be done in person at the Courthouse.  If your case has been already set for a Zoom hearing, then it will be conducted as a Zoom hearing.  As to any new hearings, they will be done in person at the Courthouse.  However you may request that the hearing be conducted remotely thru Zoom.  Both sides must agree to the Zoom hearing and it is subject to approval or rejection by the General Magistrate. Please send an email to my division email 11thFCGM08@jud11.flcourts.org requesting the Zoom hearing indicating if the other side agrees and the reason you are requesting the Zoom hearing. 

If you would like a hearing in your case on the issues that have been referred to General Magistrate Fernandez you can set the hearing using the CourtMap program or you can contact my administrative assistant Diana at 305-349-5557.  Please provide her with your name and case number and email address. If the answering machine responds, please leave a brief message including your name, case number, and telephone number.  The CourtMap program gives you the option of setting the hearing before the General Magistrate live in-person or via Zoom..

If you are going to be presenting exhibits at the zoom or telephone hearing, you must contact the opposing attorney or party and agree to the exhibits that will be admitted.  You must also provide a copy of the proposed exhibits to the General Magistrate's office by mail or Fedex no later than seven (7) working days prior to the hearing.  If the exhibits are less than 10 pages, you may send them by email by sending a copy to General Magistrate Fernandez at 11thFCGM08@jud11.flcourts.org.  The exhibits should be marked 1, 2, 3 etc for the petitioner and A, B, C etc. for the respondent.  You must also provide a copy to the opposing side or their attorney if they are represented. If you fail to provide a copy of the exhibits to the Magistrate and opposing side/attorney seven (7) days prior to the hearing, you may not be able to get them admitted at the hearing.  If there is a dispute as to the admissibility of the proposed exhibit, please contact GM Fernandez' office at 305-349-5557 to arrange a zoom or telephonic hearing prior to the regular hearing to resolve the exhibit dispute.

If you are going to be using an interpreter, you must make arrangements with a certified interpreter to attend the hearing.  Please coordinate with the opposing side to use one interpreter during the hearing.

Attorneys that have been instructed to provide a proposed report and recommendation or a report and recommended order may send the proposed report to the Magistrate through CourtMap or may send a copy of their proposed report in Word format to the Magistrate at his division email site:  11thFCGM08@jud11.flcourts.org.  Please make sure you have provided the other side with the proposed report prior to submitting it through CourMap or providing it to the General Magistrate' office.  

If you are requesting a continuance of your hearing, please email a copy of your motion for a continuance to General Magistrate Fernandez at 11thFCGM08@jud11.flcourts.org and contact his assistant to schedule a short telephonic hearing on the motion for a continuance.

If you have resolved, settled or voluntarily dismissed your case or pleading, please provide a copy of the order, settlement agreement or notice of voluntary dismissal to to General Magistrate Fernandez at 11thFCGM08@jud11.flcourts.org and contact his assistant to schedule a short telephonic hearing.
