Important Email Guidelines:
Always copy the Judicial Assistant on any court-related emails.
Include all counsel in emails regarding case matters.
Do not use “SERVICE OF COURT DOCUMENTS” in the subject line—our system will reject such emails automatically.

Placing Motions on Calendar
Email a copy of the motion to chambers.
Janet Samper will reply with the scheduled date.
File the original motion with the Clerk’s Office.
Ensure the opposing party is copied on all communications.

Courtesy Copies
Send courtesy copies to chambers by email or hand delivery.
Please note: The Clerk’s Office does not forward e-filed motions to Judge Wolfson.

Motion-Specific Procedures
Continuances: May be made ore tenus at Sounding.
JAC Motions: Email the Motion to chambers with supporting documents, JAC’s response, and a proposed order. If no hearing is requested, the Court may rule based on the submission.
Agreed Motions: Submit with signed motion or written confirmation of agreement.
Nebbia Motions: First present documents to the State. If no stipulation is reached, send to chambers. If received by 2:45 PM, hearing is typically set for the next business day.
Motions in Limine: Must be filed by the Friday before trial unless good cause is shown.
Seal/Expunge: File with the Clerk and send a copy to chambers. Counsel may be excused from the hearing if all documents are complete.
Return of Property: File with Clerk, send to chambers. Hearing will be scheduled at least two weeks later. The State must coordinate with the arresting agency regarding any objections.
Arthur Hearings: Speak with the assigned ASA first. If unresolved, contact chambers to set the matter on calendar for a bond status. Supporting materials (videos, transcripts, etc.) should be submitted at least 24 hours in advance.
Bond Motions (Increase/Reduce): File with Clerk and email or hand-deliver a copy to chambers. Include the A-form, criminal history, and any relevant documentation.
Modify or Terminate Probation/Community Control: Include positions of the PO, State Attorney, and (if applicable) the victim. Attach the A-form and criminal history if there is opposition.
Motions to Suppress: File with Clerk, send a copy to chambers. A special hearing will be scheduled soon after.

Plea Policies
If the defendant is waiving time served, Defense Counsel must complete and submit a waiver form, signed by the defendant.
The Court will not rule on a downward departure motion unless a plea has been entered or a guilty verdict rendered.

General Policies & Professionalism
All counsel must adhere to the Eleventh Judicial Circuit Standards of Professionalism, the South Florida Standards of Civility, and the Florida Bar Ideals and Goals of Professionalism.
Administrative Order 2-14-01-A1
Discovery & Depositions: If parties or witnesses fail to comply, it is Counsel’s responsibility to file Motions to Compel. The Court may deny continuances if such motions are not filed.
Case Law: Please provide relevant authority prior to the hearing for the Court’s review.
