Firearm Purchase Prohibition

You may speak with the treating physician to confirm that the physician filed the four required forms with the Miami-Dade Clerk of Court. The four required forms are:

  1. Cover Sheet
  2. Physician’s Finding & Certification by an Examining Physician of Person’s Imminent Dangerousness
  3. Patient’s Notice and Acknowledgement
  4. Application for Voluntary Admission of an Adult

After the forms are filed, a Judge or General Magistrate will review them. If the Judge or General Magistrate deems it appropriate, the Judge or General Magistrate will sign an order directing the Miami-Dade Clerk of Courts to report your friend/family member/acquaintance into the Florida Department of Law Enforcement’s database. The database includes the names of people who are prohibited from purchasing firearms and who are ineligible to apply for or retain a concealed weapon or firearms license.

The Order Determining Total Incapacity and Designating Proposed Plenary Guardian and the Order Determining Limited Incapacity and Designating Proposed Plenary Guardian instructs the Miami-Dade Clerk of Courts to report your friend/family member/acquaintance to the Florida Department of Law Enforcement (“FDLE”). The FDLE enters your friend/family member/acquaintance’s name into a database that includes the names of people who are prohibited from purchasing firearms and who are ineligible to apply for or retain a concealed weapon or firearms license.

The Order Determining Total Incapacity and Designating Proposed Plenary Guardian and the Order Determining Limited Incapacity and Designating Proposed Plenary Guardian also mandate that the person who has been declared incapacitated cannot possess a firearm.
