GENERAL INFORMATION AND PROCEDURES: 

 

ZOOM INFORMATION

- The Zoom information is the same for all Zoom hearings and is as follows:

- Parties should copy and paste the Zoom information when filing and noticing hearings 

 

COMMUNICATIONS WITH THE COURT 

- All communications must copy opposing counsel and the court staff

- The only exception is when the opposing party is pro se and has no available contact information 

 

INTERPRETERS 
- If an interpreter is needed for any hearing, the party requesting the interpreter is responsible for arranging and providing one. 

 

PRETRIAL CONFERENCES
- All pretrials will be held in-person/live in Courtroom 15A at 1:30pm. There will be no Pre-Trial hearings held on Zoom. 

-  In any  case where the defendant is an insurance company, the parties do not have to appear at Pre-Trial conference and the case will not be called by the Judge. In accordance with Florida Small Claims Rule 7.020(c), all rules of the Florida Rules of Civil Procedures shall automatically apply. (See AO NO. 21-10)

- Any case where the defendant has not been served prior to the Pre-Trial date, the Plaintiff does not have to appear and may contact the Clerk's Office for a new Pre-Trial date.

 

CALENDAR CALL & FWOP HEARINGS

- Calendar call and FWOP hearings (despite the location listed on the FWOP and Jury Trial Order) will always be conducted via zoom

 

COURTMAP & ELECTRONIC FILINGS

- All parties are strongly encouraged to create a CourtMAP account 

- Accurate email addresses and phone numbers must be provided to ensure receipt of documents and case updates

- All attorneys and self-represented litigants must sign up for an account at Florida Courts E-Filing Portal at:

INSURANCE CASES

- The following applies to all insurance cases where all defendants are insurance companies. This includes, but is not limited to, the following: personal injury protection benefits cases, bodily injury cases, automobile windshield cases, and property insurance cases including assignment of benefits.                           

In accordance with Florida Small Claims Rule 7.020(c), all rules of the Florida Rules of Civil Procedures shall automatically apply. (See AO NO. 21-10)

- When filing an emergency motion, parties should be sure to include current and accurate contact information on the motion.

- Please contact Chambers at (305) 349 7127 after submitting your Emergency Motion via E-filing to inform the court staff that said motion has been filed and provide the case number.

- The Judge will review the Emergency Motion and the Judicial Assistant will contact you with available hearing dates and times if appropriate.

- When a hearing is scheduled for an emergency matter and there is no contact information for the defendant, plaintiff must post the hearing notice on the defendant's door.

GENERAL PROCEDURES

- In order for your matter to be added to the Judge’s Motion Calendar, the motion(s) MUST be filed with the Clerk and appear on the docket. If there is any objection to the motion, a written response is required to be filed prior to the scheduled hearing.

- To coordinate a hearing, PLEASE confer with opposing counsel or self-represented litigant, once a date has been coordinated, submit Notice of Hearing and schedule via CourtMAP.

- If the parties cannot find available dates on courtMAP, kindly email the JA copying OC requesting hearing dates, include the motion and the duration needed for the hearing. If no hearing slots are available at the time of the request, parties will need to frequently check CourtMAP for any cancellations / new hearing slots.

*No eviction matters may be set on the 5-minute motion calendar. Any eviction matters set on the 5-minute motion calendar will be cancelled*

- If a motion is rejected from the 5-minute motion calendar, it is eligible to be scheduled on the 15-minute motion calendar or the appropriate special set calendar

                                           

EVICTION MATTERS

- To set a landlord/tenant matter, please email the judicial assistant with your request or schedule the hearing via CourtMAP on the appropriate calendar.

 

UNISET HEARINGS & REQUESTS

- At least three (3) documented attempts must be made to coordinate the hearing with opposing counsel or parties before sending a uniset request.

- Requests to uniset a hearing must be submitted by email to the Judicial Assistant, with proof of coordination attempts attached, and the opposing party copied (assuming the moving party has the opposing party's contact information).

- Hearings that are uniset without following proper procedures will be cancelled. 

*Uniset hearing request CANNOT occur over the phone*

 

CANCELLATIONS

- Cancellations shall be emailed to the JA and Court Specialist at least 1 day prior to the scheduled hearing with a Notice of Cancellation and/or Notice of Resolution attached.

- Counsel must contact Chambers to confirm the cancellation specifically for same day or next day cancelations.

TRIAL NOTICE PROCEDURES
- Please submit Notice of Jury Trial and/or Non-Jury Trial via E-portal/E-filing. Notice must contain all Attorneys names, phone numbers and e-mail addresses.

- The Notice must also identify who each Attorney represents, Plaintiff(s) or Defendant(s) and how many hours/days are needed.
- Once the notice is filed, email the notice to the JA

SPECIAL SET HEARING PROCEDURES

- Special Set dates are available on courtMAP. When requesting a Special Set, include the date the motion was filed or the docket index number, or the request may be rejected

- To coordinate a hearing, please confer with opposing counsel or self represented litigant, once a date has been coordinated, schedule the hearing via CourtMAP.

- In order for your matter to be added to the Judge’s Special Set calendars, the motion(s) MUST be filed with the Clerk and appear on the docket. If there is any objection to the motion, a written response is required to be filed prior to the scheduled hearing. *If the motion is not available on the docket when Special Set request is made, the request will be rejected.*

All pleadings and responses must be filed 5 business days prior to the scheduled hearing 

- If the parties cannot find available dates on courtMAP, kindly email the JA copying OC requesting hearing dates, include the motion and the duration needed for the hearing.

 

RESPONSES

If there is any objection to the motion, a written response MUST be filed 4 business days prior to the scheduled hearing.

-If the Motion exceeds 25 pages (including exhibits), please provide a courtesy copy to Chambers at least 5 business days prior to the hearing.

 

ATTORNEY'S FEES

- Attorney Fee hearing dates must be 30 days from the date the hearing is requested, if it is less, the matter will be rejected.

 

ADD-ONS

- No add-ons are permitted without prior consent of the Judge.

 

CANCELLATIONS

- Only the moving party can cancel the Special Set hearing

 - Cancellations shall be filed and emailed to the JA and Court Specialist at least 1 day prior to the scheduled hearing with a Notice of Cancellation and/or Notice of Resolution attached.
