Effective February 14,2022, ALL PRETRIALS WILL BE HELD IN-PERSON/LIVE in Courtroom #6-4 at 1:30pm. There will be no Pre-Trial hearings held on Zoom. PLEASE GOVERN YOURSELVES ACCORDINGLY. In any case where the defendant is an insurance company, the parties do not have to appear at Pre-Trial conference and the case will not be called by the Judge. In accordance with Florida Small Claims Rule 7.020(c), all rules of the Florida Rules of Civil Procedures shall automatically apply. (See AO NO. 21-10)
Also, any case where the defendant has not been served prior to the Pre-Trial date, the Plaintiff does not have to appear and may contact the Clerk's Office for a new Pre-Trial date.

CLAIMS OF EXEMPTIONS: Claims of Exemptions are considered an emergency matter and will be heard as soon as possible. If you file a claim of exemption, call chambers to confirm receipt. Claims of Exemptions will be heard on 15 minute special set calendar.

Motion Calendar Procedures:
The 5 Minute Motion Calendar consists of the following motions:
Motions to Compel Initial Discovery, Motions for Extension of Time, Motions to Quash, Motions to Reset Sale Date, Motions to Set Aside Default, Motions to Stay, Motions for Summary Judgment (Credit Card/Foreclosure Cases only), Motions to Strike (not eviction cases), Motions to Transfer, and Motions to Withdraw.
Any other motion should be Special Set for the necessary time unless otherwise given permission by the court.
EVICTION MATTERS: To set a landlord/tenant matter, please email the judicial assistant with your request. Do not set eviction matters on the 5 minute motion calendar as they will be canceled.
In order for your matter to be added to the Judge’s Motion Calendar, the notice of hearing and motion(s) MUST be filed with the Clerk. If there is any objection to the motion, a written response is required to be filed prior to the scheduled hearing.
If any party is attempting to unilaterally set a hearing, after attempts to contact opposing counsel, kindly notify the Judicial Assistant via email regarding the matter.
If any hearing is unilaterally set without the court's permission, the matter will be CANCELED.
To coordinate a hearing, PLEASE confer with opposing counsel or self represented litigant, once a date has been coordinated, submit Notice of Hearing and schedule via CourtMAP.
If the parties cannot find available dates on courtMAP, kindly email the JA copying OC requesting hearing dates, include the motion and the duration needed for the hearing.
CANCELLATIONS: Cancellations shall be emailed to the JA at least 1 day prior to the scheduled hearing. Counsel must also call the JA at (305) 349-7127 to confirm the cancellation specifically for next day cancelations. Chambers does not need a courtesy copy of the NOC (unless it is for a special set hearing).
