EMERGENCY MOTION

If you are submitting an Emergency Motion:

1.  Emergency Motions must be uploaded via CourtMAP and MUST contain a Certification that the matter is a true Emergency, and cannot wait to be heard during a regular motion calendar.  The certification/motion must include the details of the Emergency.
2.  The Emergency Motion MUST contain a statement indicating that opposing counsel has been notified, and an attempt to resolve the matter amicably has been made in good faith.
3.  Should the Court deem the motion a true emergency, you must be prepared to appear before the Court immediately after submission of the Emergency Motion to the Court. The Judge’s chambers will respond to coordinate a hearing.

Once the Court reviews the emergency motion, the parties will either receive an email with instructions, a Court Order, or a notice of hearing via CourtMAP.


CANCELLATIONS: MUST BE CANCELLED ON CourtMap and  a copy Uploaded to CourtMap prior to the hearing.
Must be requested through CourtMap. If approved, the Notice of Cancellation must state a valid reason. This does not guarantee approval of cancellation by the Judge. Please do NOT email or fax any documents to chambers.

Motion Calendar Procedures: Mandatory meet and confer requirement in the rules of civil procedure that must be followed prior to the setting of a motion.
ALL PARTIES MUST ADHERE TO RULE 1.202 CONFERRAL PRIOR TO FILING MOTIONS:

The Court mandates that all parties must meet and confer before scheduling any motions or hearings.  The setting attorney must affirm the meet and confer. 

* Conferral NOT required for: unrepresented litigants, nor for motions extending service of process, default, injunctive relief, judgment on pleadings, summary judgment, motion to dismiss for failure to state a claim, to permit class action, involuntary dismissal, directed verdict and 1.530, enforcement of judgment action, writ of possessions, section  51.011, no requirement of notice.

**COURT NO LONGER ALLOWS UNILATERRALLY SET HEARINGS**

In order for your matter to be added to the Judge's Motion Calendar, the notice of hearing and motions(s) MUST be filed with the Clerk.

NOTICE OF TRIAL

Upload and fill out the JURY TRIAL READINESS CERTIFICATION found on the bottom left hand corner under Documents. Once completed you may upload to CTMAP to advise the Court that your case is ready for TRIAL.

A copy of the filed JURY TRIAL READINESS CERTIFICATION  must be submitted (under supporting documents) and emailed to the Judicial Assistant at apracitto@jud11.flcourts.org and the Bailiff jjones@jud11.flcourts.org 
Upon execution, the parties will receive a copy of the Court's trial order. The original trial order will be e-filed by CourtMAP.
NOTE: Once a trial order has been issued, the trial is set and cannot be cancelled without an appropriate Motion for Continuance filed and set for hearing.

If parties file Notice for Trial – a copy must be provided to the JA or the Bailiff.


SETTLEMENT: Counsel shall immediately notify the Court's staff in the event of settlement by emailing a copy of the filed Notice of Settlement or Mediator's Report at apracitto@jud11.flcourts.org and jjones@jud11.flcourts.org

The moving party MUST coordinate the date/time with opposing counsel based on the Court's availability (found on CourtMap). The moving party shall submit a copy of the filed motion via CourtMap when selecting the proposed hearing date. (a notice of hearing SHOULD NOT accompany the submission).

DO NOT SET A HEARING ON COURTMAP WITHOUT COORDINATION WITH THE OPPOSING PARTY.

ANY NOTICES SENT TO PRO-SE LITIGANTS OR ANY PARTY WITHOUT A LISTED EMAIL ADDRESS, SHALL BE MAILED VIA U.S. MAIL, AND IT SHALL INCLUDE ALL ZOOM INFORMATION FOR THE HEARING.The moving party SHALL indicate on the Notice of Hearing that the Notice was physically mailed to the party, with an appropriate time for delivery.   

Submissions exceeding 50 pages TOTAL must be hand-delivered to chambers at least 3 BUSINESS DAYS prior to the hearing date.

Special Sets longer than 30 minutes, such as Attorney's Fees Hearings, Non- Jury Trials, Evidentiary Hearings need to be set with the judicial assistant or bailiff. Please send an email, copying OC, with your hearing request to apracitto@jud11.flcourts.org and jjones@jud11.flcourts.org.   Please DO NOT use two (2) 30 minute slots for the same case, otherwise your hearing request on courtMAP will be rejected 

ATTORNEY'S FEE HEARINGS
Once you e-file your Motion for Attorney’s Fees, a courtesy copy shall be submitted to the Judicial Assistant via email at apracitto@jud11.flcourts.org, and Bailiff via e-mail JJones@jud11.flcourts.org and upon receipt of the motion, the Court will issue a Preliminary Order on Motion to Tax Costs and Award Attorney’s Fees. Once the parties have complied with said Order, they must coordinate with opposing counsel and schedule accordingly on courtMAP  to schedule a SPECIAL SET Fee Hearing.
REMEMBER TO COORDINATE WITH OPPOSING COUNSEL AND CHOOSE A DATE ON CTMAP.

MOTIONS FOR REHEARING:
Motions for Rehearing / Reconsideration must be approved by the Court before they can be set for hearing. The Court will advise if the Rehearing/Reconsideration will be granted – if Granted then the party may set for a special set hearing.
ALL motions for Rehearing / Reconsideration must be specially set and will not be addressed at a UMC 5-minite motion calendar.

*When unable to find the amount time required for the said special set motion.  Kindly schedule a “CMC” on The Judge’s 5-minute motion calendar on CTMAP no motion is required. The Judge will choose the date & time, and you must make yourselves available.
