Traffic Hearing Officers may not practice law in other traffic-related matters while serving as
a hearing officer.
WORKING JOB TITLE: Civil Traffic Infraction Hearing Officer
GENERAL DESCRIPTION: This is highly responsible professional legal work conducting hearings and making rulings in the County Court Criminal Division on Civil Traffic Infraction Trials and Pre-Trials with the· exception of accident cases with injury or fatality. The Hearing Officer's powers and duties are performed in accordance with applicable state and federal laws and court rules.
RESPONSIBILITIES:
- Presides over all non-injury/fatality trials, pre-trials and parking; reviews court calendars and scheduled assignments prior to hearings; grants continuances; reads or listens to allegations and determines if action cited is supported by facts; hears and evaluates evidence of witnesses and technical experts; listens to presentations of cases; rules on admissibility of evidence and methods
of conducting testimony.
- May conduct hearings and rules on pre-trial matters and parking trials; conducts final and post judgment hearings.
- May conduct legal research including reviewing, analyzing, studying, searching, and annotating laws, court decisions, documents, opinions, briefs, and related legal authorities to prepare for court proceedings and litigated matters; keeps abreast of Florida Law Weekly.
- Handles the more difficult and complex procedural problems; researches state law, county codes and policies to ensure compliance and prepares and processes documents as needed; responds to questions and special problems of the public or various departmental representatives; establishes and maintains cooperative working relationships internally and with outside agencies.
- Attends and participates in annual Continuing Legal Education seminar.
QUALIFICATIONS: Graduation from an accredited law school, member in good standing of the Florida Bar, five years of experience in the practice of law handling related matter, completion of the required 40-hour training course approved by the Supreme Court of Florida preferred. In addition, the following knowledge, abilities, and skills:
- Thorough knowledge of state laws and court rulings as they pertain to Civil infractions and parking

- Thorough knowledge of general and specific laws, state laws, established precedents and sources of legal reference.
- Thorough knowledge of court procedures, rules of evidence, and trial and courtroom procedures.
- Knowledge of the responsibilities and authority of Hearing Officers.
- Ability to apply legal principles and specialized knowledge to individual cases and problems.
- Ability to conduct legal research.
- Ability to prepare for hearings, hear cases, and present material clearly and logically in oral and written form.
- Ability to work with litigants who are in stressful situations and maintain a positive demeanor. Ability to establish and maintain effective working relationships with the judiciary, court personnel, and intergovernmental agencies.
- Ability to communicate clearly.
- Must possess basic computer skills, including the ability to host/co-host virtual court done on Zoom platform
- Performs related work as required.
PHYSICAL DEMANDS: Work involves a significant amount of standing, walking, sitting, talking, listening, balancing. Stooping, and reaching with hands and arms; must be able to transfer up to 10 pounds.
