Due to the Supreme Court’s directive, the Court is in the process of setting 200+ trials within a limited timeframe to ensure compliance. Please be advised that due to the high volume of messages, we are responding in the order received. Kindly refrain from sending follow-up emails; we will respond as soon as we are able to provide Court availability.

Motion Calendars, Calendar Calls, and FWOP Calendars are held via Zoom.

Video appearance is required for all participants.

ZOOM ID IS DIFFERENT FOR EVERY EVENT and it can be found in CourtMap. 

Zoom Meeting ID: Seven (7) days prior to the scheduled hearing, you will receive an email from CourtMAP with the information that will allow you to appear remotely via Zoom.

 To check the status of a proposed/agreed order, please log on to CourtMAP and access your workbench folder. A list of all pending, approved and rejected submissions appear in your workbench folder.

Submission of Original Note/Loan Documents: Do not file or deliver original loan documents until Judge del Rio specifically instructs you to do so. If motion is granted or mortgagee prevails at trial, the Final Judgment is to be uploaded via CourtMAP and the Original Note/Loan Documents are to be delivered to Judge del Rio's Chambers, Dade County Courthouse, Room 525. Use delivery with tracking.

CourtMAP

Do NOT submit proposed orders through CourtMAP unless:

1. Instructed by the Court pursuant to a hearing or 2) is listed here as not requiring a hearing. DO NOT SEND PROPOSED ORDERS to JA UNLESS YOU HAVE BEEN GIVEN INSTRUCTION BY THE COURT.
2. If the order is “Agreed” or “Unopposed” submit it under “Agreed Orders,” not “Proposed Orders,” you will receive a quicker response.

 SPECIAL SETS

To request a hearing, please email and provide the following information to: dbonini@jud11.flcourts.org 

1. Case Number, Style of Case, and the Full Title of the Motion(s) for which the hearing is requested. – (Courtesy Copy of the Motion MUST be attached to email).

2. State clearly whether this is an evidentiary hearing and if testimony will be required.

3. All parties must be copied on the email request.

4. You must certify that the parties have conferred and agree on the request.

5. Indicate how much time is being requested for the hearing.

Do NOT search for available timeslots on CourtMAPThe Court will provide available dates and times. Any request referencing open slots will be rejected, as open timeslots are allocated to other approved cases.

Once you receive proposed dates from the Court, coordinate directly with opposing counsel. Do not copy the Court until both parties have confirmed agreement on a specific date and time. Then copy the Court to secure the slot.

*Once a date/time has been confirmed an email will be sent by JA confirming the time slot has been created for the special set hearing on courtMap.

1. Request the special set on CourtMAP. Please request the time slot on courtMap for the Courts approval in a timely fashion.

2. Prepare and upload a Notice of Hearing.

3. Upload motion(s) and relevant caselaw via courtMAP. DO NOT mail binders or hard copies to Chambers. 

CALENDAR CALLS

Calendar calls are held on ZOOM. Jury trials are held in person. Non-jury trials (other than foreclosures) will be decided on a case-by-case basis.

FWOP calendars are held on ZOOM. Parties are required to appear regardless of filings.  Only final resolutions (dismissals, settlements) will be excused from calendar. Please email final resolutions to dbonini@jud11.flcourts.org, all parties must be copied. Phone calls will not be accepted to confirm the status of case.

EMERGENCY MOTIONS

*All Emergency Motions must be uploaded via courtMAP once filed. Motion must include a statement confirming that opposing counsel has been notified in an attempt to resolve the matter amicably. The motion should also clearly provide the email addresses and phone numbers of all counsel of record.

*The Emergency Motion must be filed with the clerk prior to submitting it to the Court via CourtMap Emergency task.

*Ensure that the opposing party receives a copy of the Filed Emergency Motion.

* Upload the Emergency Motion via CourtMap (under emergency motion task) along with a Proposed Order (separate under proposed orders task. Please note that certain orders will not be signed without a hearing).

*Once the Court reviews the emergency motion, the parties will receive an email or the phone call with further instructions.

If you are submitting an Emergency Motion

1. Your motion must contain a certification that the matter is a true Emergency and cannot wait to be heard during a motion calendar. 

2. You must be prepared to appear before the Court within one (1) hour of submission of the Emergency Motion to the Court. 

Once the emergency motion has been reviewed by the Court, the parties will receive: an email from courtMAP with instructions, a notification from courtMAP that a hearing has been set or a Court Order.

**Motions for Judicial Disqualification must be uploaded via the emergency option on courtMAP.

Foreclosure Motions and Foreclosure Cancellations may be Noticed for Wednesday's at 9:30 a.m.

Foreclosure motion calendar hearings are limited to 5 minutes per case.  The Court will hear no more than two (2) motions per case per foreclosure motion calendar.  Foreclosure matters will only be heard on Wednesdays. 

To set a foreclosure motion for hearing:
*Select the date from the Court's foreclosure motion calendar availability (found on courtMap). 

*Submit your supporting documents (filed motion, notice of hearing, etc.) when creating the event on courtMAP.  DO NOT create multiple events on any one case; the system allows for two (2) motions to be set on each case.  If you are setting two motions, submit supporting documents for each motion. Once a green "Success" message appears, your hearing has made the calendar. 

IMPORTANT: Although the movant and the parties listed on the service list will receive an email from courtMAP indicating that an event has been created, a notice of hearing will not automatically generate.  The movant must e-file a notice of hearing via the e-portal system. 

To confirm a hearing, click on the "calendar" tab in the navigation bar and then on "view events," select the hearing date; the scheduled hearing will appear.  You can also click on "calendar," then on "events by case" and enter the case number; all upcoming hearings for that case number will appear.  

- Telephonic Appearances are not allowed.

To cancel a foreclosure motion calendar hearing
Movants cancelling a foreclosure hearing shall e-file a notice of cancellation and also cancel the hearing on courtMAP.  To do this, click on: -calendar, -view events, -select the case, -click case status ready, -click cancel from the dropdown, -click save, -select cancellation reason, -click confirm cancellation.

Motion Calendar in Division CA 05 is held via Zoom every Tuesday and Thursday at 9:30 a.m.

Motion Calendar Procedures
1. Make a good-faith effort to coordinate with opposing counsel. If reasonable cooperation cannot be obtained, the moving party may set the hearing unilaterally so long as it is scheduled at least seven (7) days before the hearing date. The Court expects that any motion may be heard eleven (11) days after its filing. 
2. File the motion and Notice of Hearing with the Clerk.
3. Upload the Motion and any supporting documents to CourtMAP no later than three (3) days before the hearing.
4. Responses:  Parties wishing to submit a response to a matter set on Motion Calendar must file said response with the clerk's office and upload documents through CourtMAP. 
* Cancellations - When Notice of Cancellation is filed there is no need to contact the chambers to advise of cancellation, please email dbonini@jud11.flcourts.org and jmanjarres@jud11.flcourts.org, all parties must be copied. Cancel your motion via CourtMap.

* ALL CASES MUST GO TO MEDIATION BEFORE THE TRIAL DATE.

After Notice of Trial is filed please go to CourtMap to schedule the Trial (under Calendar Call). Coordination is required.

All Jury Trials will go forward in person. EXHIBITS ARE NOT TO BE UPLOADED.

All Non-Jury Trials will go forward by zoom unless requested in person. Exhibits are to be uploaded 5 days prior to the trial (please see the clerk's memo).

All Calendar Calls are conducted via Zoom.

Notice of Unavailability is not sufficient to continue trials. Appropriate Motion for Continuance with consent must be filed timely and scheduled for Hearing prior to the calendar call on the motion calendar held on Tuesdays and Wednesdays (email the JA at dbonini@jud11.flcourts.org)

Email notice of readiness to dbonini@jud11.flcourts.org to receive trial periods.Upon execution, the parties will receive a copy of the Court's trial order.  The original trial order will be e-filed by CourtMAP.  

Note: Once a trial order has been issued, the trial is set and cannot be cancelled; the appropriate motion must be filed and set for hearing. 

*Counsel shall notify the Court's staff in the event of settlement by emailing a copy of the filed Notice of Settlement or Mediator's Report to dbonini@jud11.flcourts.org and shall submit the appropriate Order of Dismissal or Voluntary Dismissal for execution via courtMAP. 

Jury Trial Certification – The Certification Form (found in the Judge's documents) should be completed by the parties when discovery has been completed, dispositive motions, Daubert motions, and motions in limine have been ruled upon, and jury instructions have been prepared and agreed upon, in other words, all pretrial work is complete.

Once completed, the Certification form should be emailed to the Judge’s Judicial assistant at dbonini@jud11.flcourts.org. If approved by the presiding Judge, the cases certified ready for trial will be placed on the Master List prior to receiving a trial date. The Judge will sign an Order Placing Case in Inactive Status (found in the Judge's documents).
Settlements – Notice of Settlement must be executed by all parties and filed prior to case removal from trial docket. Please submit the notice of settlement via email dbonini@jud11.flcourts.org
Submissions – Please submit the Mutual Pre-Trial Stipulation, all Motions in Limine, Jury Instructions and Verdict Forms to the Court, via CourtMAP under “Trials”, 2 days prior to the first day of Trial.

Additional Instructions

Upload motions and proposed Orders via courtMAP, DO NOT mail hard copies to Chambers. 
Orders must be submitted in Word format to allow for editing by the Court and electronic signing. The companion Motion and attachments, if any, must be uploaded to the "Supporting Documents" tab in PDF format.
Orders to Withdraw must be heard on motion calendar absent written consent by the client. 
Agreed Orders must be identified as such in the title.

PROPOSED ORDERS

*Supporting documents (i.e.: motions, affidavits, cover letters, etc.) must always be submitted in support of a proposed order. 
*Do not submit proposed orders on matters that are contested and/or already set for hearing. 
*If you are submitting a proposed order after a hearing, you must submit a cover letter that includes the hearing details and the Court's oral ruling. 
*If you are submitting an AGREED order, please select the AGREED order option.
*When submitting a proposed/agreed order, the title of the order must be typed in the title box provided by courtMAP, NOT within the body of the proposed/agreed order. 

*NOTE: courtMAP automatically adds the case style, order title, judge's signature block and the done and ordered language to the order.  
*Final disposition forms must be submitted with all Final Orders of Dismissal and Final Judgments.

*If submitting a Motion to Withdraw as counsel, please identify if the case is currently set for trial.  If a Final Judgment has been entered, please indicate this in your motion.

*Ex-Parte Motions to Compel: must contain certification of “good faith effort” required by Rule 1.380(a)(2).

An email must be sent to both dbonini@jud11.flcourts.org and jmanjarres@jud11.flcourts.org with a Notice of Cancellation, all parties must be copied. Phone calls will not be accepted for cancellations or rescheduling of hearings. 

Add-Ons: No additional motions may be added to a specially set hearing without permission from the Judicial Assistant.
