NEW MANDATORY CASE MANAGEMENT PROCEDURES


In compliance with Florida Supreme Court Administrative Order 20-23A12 and the 11th Judicial Circuit Administrative Order 21-09, lawyers and litigants are required to follow the procedures outlined below:

A.   For cases filed BEFORE APRIL 30, 2021, you MUST submit CASE MANAGEMENT REPORT AND ORDER via CourtMAP under Proposed Orders.

B.   DO NOT submit a Case Management Report and Order if:
             1. There is already an EXISTING CASE MANAGEMENT ORDER setting forth all pretrial deadlines.
             2. Your case is already set for trial.
             3. Your case is currently on inactive status by court order.
             4. Your case is subject to current moratoria.
             5. Your case is subject to F.S. 51.011
             6. If your case has been Noticed for Lack of Prosecution Hearing (FWOP) unless it is being attached to  your WRITTEN GOOD CAUSE SHOWING.
             7. Your case is uncontested.

C.   If your case meets any of the exceptions listed above, you must still follow the timeline requirements set forth in the 11th Judicial Circuit Administrative Order 21-09.

D.   If your case was filed ON OR AFTER APRIL 30, 2021, the Court will issue a Case Management Order with prescribed timelines.

Submit the e-filed Emergency Motion to the Emergency Motions tab on CourtMAP. You may also submit a proposed order to the proposed orders tab on CourtMAP.

Once the Court reviews the emergency motion, the parties will receive an email with further instructions.

Foreclosure calendars are held on Tuesdays at 9:00am (Availability can be found on CourtMAP)

All Foreclosure calendar hearings will be conducted via Zoom. Seven (7) days prior to the scheduled hearing, you will receive an email from courtMAP with the information that will allow you to appear remotely via Zoom.

Only one (1) motion per case will be heard.  A copy of the motion and notice of hearing must be submitted through Courtmap within two (2) business days prior to the hearing date. The filed motion and all documents in support must be attached when the hearing is scheduled. Once a green "success" message appears, the hearing has made calendar. You must still prepare, file and serve a Notice of Hearing. You must give 7 business days notice.

Motions for default must be submitted with proof of service, affidavit of diligent search and proof of publication (where service is by publication) and non-military affidavit(s). One motion per defendant.

Notices of Cancellation- Hearings must be cancelled on CourtMAP. A notice of cancellation must also be e-filed.

A copy of the Motion and Notice of hearing must be submitted through E-file. If the Motion and Notice are not submitted through E-file the Motion will not be heard.

Select the calendar call/trial date from the Court's available dates.

Submit a copy of the filed notice of readiness (under supporting documents) in order for the matter to be set for trial.

Upon execution, the parties will receive a copy of the Court's trial order via CourtMAP.

If the case settles, please email a notice of settlement to: gmartin@jud11.flcourts.org 

Original Notes must be mailed to the clerks office at least 1 week before the trial.

Additional Instructions

Proposed orders must be submitted in Word format via CourtMAP. DO NOT mail them to Chambers.

 

ALL proposed Orders MUST be submitted in WORD format on the CourtMAP pre-generated blank Order form and must be accompanied with a motion and supporting documents or a letter of explanation. All proposed Orders MUST be titled in the block marked "Generic Order-You must rename the Order Title"

When submitting your proposed/agreed order, the title of the order must be typed in the title box provided by courtMAP, NOT in the body of the proposed/agreed order.

If you are submitting an AGREED order, please select the AGREED order option; otherwise, the order will not be titled "Agreed".

Additional Instructions

The moving party MUST coordinate the date/time with opposing counsel based on the Court's availability (found on courtMAP) and shall submit a copy of the filed motion along with the Court's Request for Special Set form via courtMAP when selecting the proposed hearing date for the Court's approval (a notice of hearing SHOULD NOT accompany the submission).

To Schedule a Hearing: You must submit the completed Special Set Hearing Request Form and the motion(s), exhibits, affidavits, transcripts, legal authority, etc., via courtMAP. If one or more supporting documents are missing, your special set request will be rejected. Although a Notice of Hearing is automatically generated, the hearing is not scheduled until you receive an email that specifically reflects the status as "Approved." If approved, the court-generated Notice of Hearing will be automatically filed with the Clerk's office. DO NOT FILE A NOTICE OF HEARING FOR SPECIAL SETS.


Supporting Documents: Each supporting document must be submitted separately, and each must be properly titled for ease of review. Responses and any other Supporting Documents must be timely uploaded via courtMAP to the appropriately scheduled hearing no later than seven (7) business days prior to the hearing date. All documents must be submitted electronically via courtMAP in pdf format. No binders need to be mailed to chambers. 


Special Sets for more than one (1) hour: If you would like to request a Special Set hearing that is more than one (1) hour, please send an email to the Judicial Assistant at gmartin@jud11.flcourts.org with all parties copied. Please ensure the motion is attached, any supporting documents, the amount of time you are seeking, and the reason for seeking that amount of time.


Evidentiary Special Sets: If your Special Set hearing is an Evidentiary hearing, please indicate as such on the Special Set Request Form so that the court can schedule the appearance of a clerk at the hearing. Also, please see Administrative Memorandum on Exhibits during the Pandemic for procedures on the use of exhibits during the hearing.


Cancellation Policy: Only the Court can cancel a special set hearing. Prepare the proposed Notice of Cancellation (NOC), specifying the reason for the cancellation, and upload it as a separate submission to the courtMAP hearing event; and immediately contact chambers to advise that the proposed NOC has been uploaded. The Court will review the proposed NOC, and, if good cause is shown, will cancel the special set hearing. If the hearing is canceled, the NOC must be filed with the Clerk's office.


Motions for Reconsideration, Rehearing, New Trial, and other post-trial motions (excluding Entitlement to Fees and Costs: These motions will not be heard on motion calendar and should not be set for hearing unless instructed to do so by the Court. Email your motion to gmartin@jud11.flcourts.org The Court will review the motion and instruct the parties on how to proceed.
