INMEDIATELY UPON THE CASE BEING AT ISSUE, COUNSEL SHALL FILE THE SCHEDULING ORDER ON COURTMAP (TEMPLATE AVAILABLE UNDER PROPOSED ORDERS). 

SCHEDULING ORDERS SHALL BE FILED ON ALL TRIAL MATTERS. DIVISION 31 OPERATES UNDER A SCHEDULING ORDER. THE DATES IN THE SCHEDULING ORDER SHALL SUPERSEDE THE TRIAL ORDER. IN THE EVENT OF CONFLICTING DEADLINES, PREVIOUSLY ENTERED CASE MANAGEMENT ORDERS (CMO) OR SCHEDULING ORDERS MUST BE FOLLOWED. THE EARLIEST APPLICABLE DEADLINE WILL BE ENFORCED. THE CMO/SCHEDULING ORDER SUPERSEDES ANY CONFLICTING DEADLINES ESTABLISHED BY THIS TRIAL ORDER. DO NOT RELY ON THIS TRIAL ORDER TO EXTEND ANY PRIOR DEADLINES.

WITNESS TESTIMONY FOR TRIAL: Witness testimony must be secured prior to trial-continuances for witnesses/expert will not be granted

DURING JURY TRIAL: There SHALL be a Stenographer present 

ONLY AGREED ORDERS SHOULD BE UPLOADED ON THE AGREED ORDER PLATFORM ON COURTMAP.

MOTION CALENDAR IS CONDUCTED VIA ZOOM VIDEO CONFERENCE. 

SPECIAL SET HEARINGS ARE CONDUCTED VIA ZOOM UNLESS OTHERWISE INDICATED. ALL HEARINGS OVER ONE HOUR, WILL NOW BE IN-PERSON AT COURTROOM 5-1.

ALL ZOOM HEARING PARTICIPANTS SHALL RENAME THEMSELVES TO INCLUDE FIRST AND LAST NAME AND CASE NUMBER BEFORE JOINING THE MEETING.

Purpose of the Breakout Room during a Video Zoom Conference:
Counsel Attending a Hearing must Meet and Confer before starting the Hearing while they are placed in the Breakout Room.

ALL MOTIONS SHALL BE ADDED ON THE COURTMAP UNDER VIEW ALONG WITH EXHIBITS, ANY AFFIDAVIT, AND/OR CASE LAW THE PARTIES WANT THE COURT TO CONSIDER.

ONLY TRIAL COUNSEL AND NOT COVERAGE COUNSEL SHALL APPEAR AT A CASE MANAGEMENT CONFERENCE.

Procedure upon filing a Motion for Rehearing: When the Response has been filed, then upload competing orders on the rehearing. The Judge will grant the rehearing based on the pleadings filed.

 Courthouse is OPEN.  Most court proceedings will continue to take place remotely, via Zoom.  However, Jury Trials, ALL HEARINGS OVER ONE HOUR, and any evidentiary hearings, the Court has ordered to be live will take place in Courtroom 19D of the Osvaldo N. Soto Miami-Dade Justice Center, located at 20 NW 1st Avenue, Miami, FL 33128.

Submission of Original Notes: All original notes and mortgages must be mailed to 20 NW 1st Avenue, Suite 19.265, Miami, FL 33128 to the JA's attention. The original notes and mortgages must be received by chambers at least three (3) days prior to your scheduled hearing with a cover letter that includes: (1) the case number, (2) case style, and (3) division number.

Submission of Evidence for Zoom Hearings and Zoom Trials:  At least five business days prior to the hearing or trial, each side must:
1. Mark the first page of each document it intends to introduce into evidence.  (Plaintiff with numbers/Defendant with letters.)
2. Submit to the e-Portal, in the manner detailed below, an Exhibit List, containing the exhibit number/letter, with the corresponding brief description of the exhibit, and all exhibits separately
          To Submit:    a.  Go to the eFiling Portal;
                               b.  Click on "File Pleading in Existing Case;"
                               c.  Enter Case Number;
                               d.  Once case populates, go to the documents tab, click "Add;"
                               e.  Once Search Bar appears, type "EVIDENCE" and hit "Enter;"
                               f.   Check Off Evidence Submission, then hit "Browse" which allows you to select the respective document to be uploaded; and
                               g.  Click "Save." 
By submitting the documents as indicated above, these go into a separate Evidence Queue that allows the Cle

    **NOTE: No in-person appearances will be permitted in Division 31 absent further order.  It is ORDERED that, effective immediately, all proceedings in Division 31 (Judge Sanchez-Llorens) shall be conducted via Zoom.

     

    EMERGENCY MOTIONS PROCEDURE:

    1. File with the Clerk of Courts either in person or via the e-portal.

    2. Forward a copy of the motion to opposing counsel.

    3. Submit the filed copy to chambers via CourtMAP as an "Emergency Motion" with a cover letter attached as a supporting document.

     

    *Once your Emergency Motion has been submitted through CourtMAP as an "Emergency Motion," the Judicial Assistant or the Bailiff will contact your office via e-mail to schedule a hearing, if appropriate.


    Emergency Motion to Cancel/Reschedule Foreclosure Sale: If ALL parties agree to cancel/reschedule the sale, upload an agreed order with a cover letter to CourtMAP making sure that all parties have reviewed the order before submittal. Once the agreed order with cover letter has been uploaded, call chambers to alert the Court.

     

    **NOTE: The Court will not schedule an Emergency Hearing on a new case where there has not been proper service. A return of service must be filed with the Clerk of Courts.  Once service has been made, call and send chambers an e-mail with all parties copied to schedule an Emergency Hearing, if appropriate.
