AS OF APRIL 1, 2023, the presumptive method of appearance for Pre-Trial Conference, Special Sets (MSJ's, etc..), Evidentiary hearings, Bench Trials will be held Live/in-person.
AGREED ORDERS:
-All
agreed orders must be submitted via COURTMAP.
-ALL Orders MUST be submitted in WORD format on the courtMAP pre-generated blank Order form and must be accompanied with a motion and supporting documents or a letter of explanation.
-DO NOT SUBMIT ORDERS MORE THAN ONCE.
-Once submitted, the order will remain in “Pending” status until it is either entered or rejected by the Court.
-DO NOT mail them to Chambers
-When submitting an Agreed Order, the title of the Order must be typed in the title box provided by CourtMap NOT in the body of the agreed order.
-If you’re submitting an
Agreed Order, please select Agreed Order
Option, otherwise the order will not be titled agreed.
PLEASE submit your Emergency Motion through courtMap and make sure the Emergency Motion has been filed with the Clerk of Court and provided to opposing counsel. Call Chambers to confirm that we received your Emergency motion. Upon the Judge's review of the Motion, we will contact you office with instructions.

Motions must be set via CourtMAP.
Motion Calendar hearings are limited to ONE Motion per hearing date/per case and is for 5 minutes only, otherwise, the Court will cancel the hearing. Motion Calendars are held on MONDAYS and WEDNESDAYS at 9:30am (Availability can be found on COURTMAP)
Motion Calendar is conducted by phone. All parties must be on the phone (at the same time) when calling Chambers at 305-349-7012 at the time of the hearing.
**RESPONSES
Parties wishing to submit a response, must be sure to file said response with the Clerk of courts and submit via courtMAP under Motion Calendar tab prior to the hearing date.
**COORDINATION IS MANDATORY. Parties must coordinate with one another. You must give 7 business days' notice. A copy of the Notice of hearing must be submitted through E-file. The Notice of Hearing must indicate the name of the person the hearing was coordinated with and the date the motion was filed.
**A party may set a 5-minute motion or a status conference unilaterally ONLY if reasonable attempts to reach the opposing party have been unsuccessful and the opposing party has been given reasonable opportunity to respond. After obtaining the date and time (from CourtMAP) for a unilaterally set hearing, the notice must include the language that undersigned set this matter unilaterally after good faith efforts to reach the opposing party were unsuccessful.
All available dates are posted on CourtMAP. Parties are to check CourtMAP daily for cancellation/availability.
***EVICTIONS MATTERS (Landlord & Tenant matters): can be scheduled during Regular Motion Calendar (Monday & Wednesday at 9:30am) OR email the judicial assistant with your request.
***E-FILING is not the same as CourtMAP. Matters that are only e-filed WILL NOT automatically upload to the Judge's Motion Calendar. E-Filing is for documents to be filed with the clerk's office electronically.
***If you would like to set more than one motion per case per hearing date, you MUST do so on the Special Set Calendar. Motions that are not five minutes are subject to cancellation.
MOTIONS THAT MUST BE SPECIAL SETS: Motions for Summary Judgment or Final Judgment, Motions in Limine, Motions for Sanctions, Motions for Attorney Fee Hearings, Motions for affirmative defenses, Motion for In-Camera Inspection, Evidentiary Hearings and Any Motion that will take more than five (5) minutes.
MOTIONS FOR REHEARING OR MOTIONS FOR RECONSIDERATION: Must be e-filed then faxed to Chambers before setting on the calendar. If the Motion is more than 10 pages (including exhibits) please deliver a courtesy copy to Chambers. Please do not schedule on Motion Calendar as they will not be heard.
NOTICE OF CANCELLATION: The movant party is allowed to cancel hearings on Court Map. A Notice of cancellation must also be e-filed through the E-filing portal prior to the scheduled hearing even if you have submitted a proposed/agreed order through CourtMAP. Chambers does not need a courtesy copy of the NOC, however the party cancelling the hearing should give a courtesy call or email to the judicial assistant (specifically for same day or next day cancellations). This will be greatly appreciated. Notice must state Reason for Cancellation.
TRIALS:
You must e-file your Notice for Trial with the Clerk's
office, then fax a courtesy copy to chambers at 305-349-7093.
Please indicate on your Notice for trial if the case has been mediated.
MOTIONS TO CONTINUE JURY TRIAL WILL BE HEARD AT CALENDAR CALL.
On the service list you MUST include all parties’ email
addresses to the case to assure proper delivery of Trial Order via CourtMap.
If a
party to the case does not have an email address, the Plaintiff is hereby
directed to notify all parties by US Postal regular mail.
1) JURY TRIAL:
Available
Calendar Call/Trial periods are posted on CourtMAP. Select the Calendar
Call/Trial date from the Court's available dates. The notice of readiness
must be e-filed with the Clerk of Courts before setting the hearing. Upon
execution, the parties will receive a copy of the Court's trial order thru
CourtMAP.
***NOTE: Motions
for Continuance will be addressed at Calendar Call. Once a trial
order has been issued, the trial is set and cannot be cancelled; the
parties will have to file the appropriate motion.
2) NON-JURY TRIAL:
Notice
for Non-Jury Trial must be e-filed with the Clerk of Courts, then a courtesy
copy must be mailed or faxed to Chambers. Notice for trial shall contain
all Attorneys names, phone numbers and e-mail addresses. Non-Jury Trials are set by Chambers. Parties will receive the Court's Trial Order through CourtMAP.
**NOTE:
The parties must submit all evidence no less than 5 Business days
prior to the trial, by going to the clerk's e-filing portal and using
the Evidence submission button.
CASE
SETTLED: In the event the case is settled,
a copy of the filed Notice of Settlement or Mediator's Report shall be emailed
nfresin@jud11.flcourts.org to Chambers.
PROPOSED ORDERS:
1) All proposed orders must
be submitted in Word format using the pre-generated blank order form on
courtMAP.
- Each submission must be accompanied by the corresponding motion
and all supporting documents or a letter of explanation. Supporting
documents (i.e: motions, affidavits, cover letters, etc.) must always be
submitted in support of your proposed order.
- CourtMAP
automatically populates the case style, order title, judge’s signature block,
and the "Done and Ordered"
language.

DOCUMENTS TO THE ORDER*.
2) DO NOT SUBMIT ORDERS MORE THAN ONCE.

SPECIAL
SET HEARINGS:
All
motions must be E-filed to the Clerk of Courts before setting the Special
Set Hearing.
COORDINATION
IS MANDATORY: The Moving party MUST coordinate the date and time with opposing
counsel based on Court's availability found on CourtMAP.
Motions for Summary Judgement are on Tuesdays.
Motions for Final Summary Judgment are on Monday and Tuesday Afternoons between 1:30PM and
4:30PM.
SPECIAL
SET HEARINGS CAN NOT BE UNILATERALLY SET AND ARE IN PERSON.
BINDERS
ARE NO LONGER REQUIRED.
*Do not double up on time
slots (i.e. schedule two consecutive 15 minute
Special Set times in order to argue a 30 minute motion). Doing so will
result in rejection of date selection.
* SPECIAL
SET HEARINGS are NOT scheduled until they are approved by the
Court. Moving Party must submit a copy of the filed motion (only the
motion) via CourtMap when selecting the proposed hearing date. DO NOT
attach a Notice of Hearing with your submission. Upon approval, the parties
will receive an automated email indicating same. The parties will also be
served a notice of hearing which will be automatically e-filed. If
proposed notice is rejected, the parties will receive a message along with the
reason for the rejection.
*The movant MUST e-file the notice of hearing (once
approved by the COURT). Please indicate the name of the person the hearing was
coordinated.
*MOTIONS
FOR RECONSIDERATION/REHEARING: Motions for
Reconsideration/Re-Hearing MUST be e-filed
first. Please do not set on Motion Calendar for the motion will not be
heard. Motion MUST be reviewed and approved by the
Judge before scheduling; therefore, if the motion is 10 pages or
less, please fax to Chambers at 305-349-7171; if the motion is more than
10 pages it MUST be mailed or hand delivered to Chambers.
**ADD-ONS: No
Add-ons are permitted without prior consent of the Judge. Please submit a
letter with the Motion for approval via CourtMAP as Proposed Order.
**NOTIFY
COURT OF ALL CANCELLATIONS AT LEAST 24 HOURS PRIOR TO HEARING. Notice
must state Reason for Cancellation. Notice of Cancellation
must be e-filed to the Clerk of Courts .The party that noticed the hearing may
cancel via courtMAP after it files its Notice of Cancellation. Parties are
to call Chambers to confirm the cancellation.
**TELEPHONIC
APPEARANCE: A motion for
telephonic appearance MUST be submitted through CourtMap along with an
order for Judge's approval. The Motion must include the reason for the
request.
****Please Note: Special Sets needing longer than
60 minutes (PIP cases, fee hearings, etc.) must be set by Chambers. To do
