Court Policy – Division 10 (Judge Lopez)

 > All attorneys are solely responsible for serving notice on all parties involved in a case.

> The Court and Judge Lopez’s office will NOT, and are NOT responsible for, providing notice of hearings, trial settings, calendar calls, or orders entered by the Court. This obligation remains in effect even where the opposing party is self-represented (pro se) or has been Defaulted.

> Furthermore, any request for a special set hearing in Division 10 must include a completed Special Set Form attached at the time of submission. Requests submitted without the required form will not be accepted or scheduled.                                              

> Effective Immediately: ALL Case Management Joint Reports MUST BE FILED FIRST and REFLECT on the Docket, once it reflects on the docket, you may submit an Agreed Order through Court Map, under Agree Orders for Judge Lopez Approval and Signature. 

> In compliance with Florida Supreme Court Administrative Order 20-23A12 and the 11th Judicial Circuit Administrative Order 21-09, lawyers and litigants are required to follow the procedures outlined below:

A.   For cases filed BEFORE APRIL 30, 2021, you MUST submit CASE MANAGEMENT REPORT AND ORDER via CourtMAP under Proposed Orders.

B. DO NOT submit a Case Management Report and Order if:

    1. There is already an EXISTING CASE MANAGEMENT ORDER setting forth all pretrial deadlines.
    2. Your case is already set for trial. 
    3. Your case is currently on inactive status by court order.
    4. Your case is subject to current moratoria.
    5. Your case is subject to F.S. 51.011.
    6. If your case has been Noticed for Lack of Prosecution Hearing (FWOP) unless it is being attached to your WRITTEN GOOD CAUSE SHOWING.
    7. Your case is uncontested.   
C.   If your case meets any of the exceptions listed above, you must still follow the timeline requirements set forth in the 11th Judicial Circuit Administrative Order 21-09.
D.   If your case was filed ON OR AFTER APRIL 30, 2021, the Court will issue a Case Management Order with prescribed timelines.

> Submission of Original Notes: DO NOT FILE ORIGINAL LOAN DOCUMENTS.

> The original note/loan documents are to be delivered to:  Clerk of Courts Attn: Notes and Mortgages, Location: Osvaldo N. Soto Miami-Dade Justice Center, 20 NW 1st Court, 3rd Floor, Miami, FL 33128 and also Use delivery with tracking. 

> LOST NOTE: The Court requires an Indemnity Bond for any Lost Note.
