NEW MANDATORY CASE MANAGEMENT PROCEDURES:   In compliance with Florida Supreme Court Administrative Order 20-23A12 and the 11th Judicial Circuit Administrative Order 21-09, lawyers and litigants are required to follow the procedures below:

    1.  All cases filed BEFORE APRIL 30, 2021, you MUST submit CASE MANAGEMENT ORDER via CourtMAP under Proposed Orders.

    2.   DO NOT submit a Case Management Order if:
              a. There is already an EXISTING CASE MANAGEMENT ORDER setting forth all pretrial deadlines.
              b. Your case is already set for trial.
              c. Your case is currently on inactive status by court order.
              d. Your case is subject to current moratoria.
              e. Your case is subject to F.S. 51.011
              f. If your case has been Noticed for Lack of Prosecution Hearing (FWOP) unless it is being attached to your WRITTEN GOOD CAUSE SHOWING.
              g. Your case is uncontested.

      3.   If your case meets any of the exceptions listed above, you MUST still follow the timeline requirements set forth in the 11th Judicial Circuit Administrative Order 21-09.

      4.   If your case was filed ON OR AFTER APRIL 30, 2021, the Court will issue a Case Management Order.

Foreclosure Motion Calendar Procedure

In order for your matter to be added to the Foreclosure Motion Calendar, the notice of hearing and motion(s) MUST:  
Parties are required to MEET AND CONFER prior to setting motions on calendar. (The parties are required to speak over the phone, in-person or via zoom. Emails do NOT satisfy this requirement.)
(1) be filed with the Clerk; and 
(2) courtesy copies, including supporting documents, if any, must be submitted via courtMAP under "Foreclosure Motion Calendar" or the matter will NOT be heard.

Responses:  Parties wishing to submit a response to a matter set on Foreclosure Motion Calendar must file said response with the Clerk and submit it via CourtMAP under "Foreclosure Motion Calendar" case number and hearing date, prior to the hearing date.


Efiling is not the same as courtMAP. Matters that are only e-filed WILL NOT automatically upload to the Judge’s Motion Calendar. Efiling is for documents to be filed with the Clerk's Office electronically. CourtMAP is used to submit courtesy copies to chambers electronically 

RESETTING OF HEARING:

     If a hearing is being reset, both the new notice of hearing, the motion, attachments, and any responses must be uploaded to the Judge's Foreclosure Calendar as they do not carry over from the previous calendar. Any Motion not uploaded will not be heard.

Cancellations:  Counsel for the party who placed a matter on the Motion Calendar shall file the notice of cancellation with the Clerk. If the case was set through CourtMAP you must cancel it through CourtMAP. You do not need to call chambers to cancel Foreclosure Motion Calendar Hearings.

 Motion Calendar Procedures:
     For your matter to be added to the Judge’s Motion Calendar, YOU MUST:
File motion with the Clerk; and Coordinate hearing with opposing counsel using CourtMap.
A WRITTEN MOTION IS REQUIRED TO BE FILED.
THE COURT WILL NOT ADDRESS MOTIONS THAT HAVE NOT BEEN SUBMITTED/UPLOADED INTO THE MOTION CALENDAR QUEUE IN COURTMAP.

Once the hearing is scheduled, upload a Notice of Hearing with the Clerk with the Zoom Information.
Upload motion, including supporting documents, if any, via CourtMAP under "Motion Calendar"  at least seven (7) days prior to the hearing or the matter will NOT be heard.

EX PARTE MOTIONS TO COMPEL: Before filing an ex-parte motion to compel please make sure you have complied with Eleventh Circuit Court Administrative Order No. 06-09 .  Motions that do not reflect compliance with the Administrative Order will be summarily denied.

TRIAL

Set your case on one of the court's available motion calendars to obtain a trial date. 

ALL cases not reached during a trial period will be automatically rolled over to the next trial calendar.  FOR ALL CASES ROLLED OVER - No additional discovery, exhibit list, or witness list will be permitted without leave of the Court. Remember all calendar calls are via zoom only!

JURY TRIALS AND NON-JURY TRIALS ARE ALWAYS HELD IN PERSON.

Motions to Continue Trial must be set on the five (5) minute Motion Calendar, 
The ONLY way to be removed from the Trial Docket or be excused from Calendar Call is via Court Order, Order of Dismissal. A Notice of Settlement and Stipulation ARE NOT SUFFICIENT, failure to appear at Calendar Call may result in sanctions and/or the striking of pleadings.

ALL CASES THAT ARE ON THE COURT'S TRIAL DOCKET ARE ON 1 HOUR STANDBY.  

ALL CALENDAR CALLS will be held via ZOOM, DO NOT APPEAR in person.

 
Regarding Trial/ Calendar Call

A Notice of Settlement is NOT enough to be excused.

Please see below the Courts Requirements to be excused.
If you cannot do the below, then the parties MUST appear.

The Court is requiring the parties to do one of the below:
1- Submit an Order of Dismissal 

     With the language - The Court retains jurisdiction to enforce the terms and conditions of the settlement agreement.

2- File a Notice of Voluntary Dismissal

     With the language - The Court retains jurisdiction to enforce the terms and conditions of the settlement agreement.


     The word "stipulation" CANNOT be used, if you use the word "stipulation" the Clerk’s Office does not accept it and you will be required to appear before the Court for Calendar Call/ Trial.

**Jury Trials, Non-Jury Trials and All Evidentiary Hearings are held in person unless the court directs otherwise.

Special Set Hearing Procedures (any special Set hearing that has been granted more than 30mins will need to be in person not on zoom)  

Special set hearings can only be set during special set weeks and not during trial periods. Special Sets will be approved for hearings of 15 to 30 minutes, if your motion requires more than 30 minutes you will need to set the matter on motion calendar to request a special set for 45mins or more, the court will then place it on one of the courts non-jury trial docket which the parties will have to appear via zoom on whichever calendar call the court places it on.

Special Set Motions may not exceed 25 pages, double spaced, 1inch margins with 12PT Fonts.

Responses are limited to 20 pages and are due 10 days prior to the hearing; no reply's will be allowed. 

Motions requiring Special Set should be set within a reasonable amount of time from when the motion was filed.

Special set hearings must be coordinated and set through courtMAP.  In the event the party seeking to set a hearing is unable to secure reasonable cooperation from opposing/co-counsel, the will set it on Motion Calendar to Compel Cooperation.  The Court expects that any motion may be heard within 30 days of filing and, as a result, a failure to agree upon a date within this time frame is presumptively unreasonable.

We do not use binders. All supporting documents must be uploaded through courtMAP. 

 * All motions MUST be filed with the Clerk prior to scheduling a special set hearing.

- Select your date and upload your document(s) through courtMAP
- Your date selection on courtMAP will generate a Special Set Request email to Chambers. Chambers will review your submission and approve or reject. Please make sure to upload in courtmap the Notice of Hearing and the Motion.  It is very important to label each submission (i.e) "Notice of Hearing", "Motion to Dismiss"!  Do not simply submit a PDF without it being labeled. 
- Once approved, you will receive a Notice of Hearing from courtMap.

Please Note No Broken Time Selections:  Do not set a special set with broken time:  For example, if the parties have a special set that require 30mins. and you find at time at 10:00AM you cannot have the additional start time at 10:30AM.   10:00 AM - 10:30AM is good.  10:00AM (for 15mins) and then Start again at 10:30AM (for 15mins) is not good and it will be cancelled all together. *** Any documentation for the hearing shall be uploaded and e-filed AT LEAST TEN (10) DAYS PRIOR TO THE HEARING (in addition to uploading your documents to courtMAP)***  any matters that are not provided as instructed, will not be heard at the special set hearing.

Please do not submit paper courtesy copies on any matter. All Notices, Motions, Responses must be downloaded in courtmap. 

Add-Ons: If both parties can agree to address the motions in the allotted time and with the understanding that no more time will be added, that is fine. Please ensure that the documents are uploaded onto a court map.
Uploading Additional Documents:  In order to verify your case is on the Calendar AND in order to upload additional documents: 
    a. Log onto courtMAP;
    b. Select “calendar” on top;
    c. Select “show events by case”;
    d. Enter your case number & hit the magnifying glass; and
    e. Your case hearings will populate

All documents you would like Judge Trawick to review for a hearing should be uploaded on courtMAP to the event as supporting documents. DO NOT send supporting documents by email.  Ensure that the motions are uploaded separately or apart from exhibits.  

SPECIAL SET HEARING CANCELLATIONS:

To request the cancellation of a special set hearing, you must email the J.A. at ASoto@jud11.flcourts.org  and CC all parties involved. Your email must include the case information (style, hearing type, date set, etc.) as well as the reason why you are seeking the cancellation of said hearing.  If you have not received a response from the J.A. within 24 hours, you must follow up with a telephone call to chambers to confirm whether the hearing has been cancelled. **Parties will NOT be able to cancel a special set hearing on courtMAP.

**EVIDENTIARY HEARINGS MUST BE DONE IN PERSON
